Terms of Service ("Terms of Use")

1. Eligibility

You must be at least 18 years of age and the age of legal majority in your jurisdiction to use our Services. You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, or any other jurisdiction where the use of our Services would be illegal or otherwise violate any applicable law.

2. The "Sorry for Winning" Service

SfW provides a gamified crypto entertainment universe featuring trading competitions, skill-based games, and a player-driven virtual economy.

• Competitions ("Races"): Users may participate in time-limited trading competitions.
• Platform-Hosted Wallets: To participate, you must deposit a specified amount of a designated token into a temporary, platform-hosted wallet created for you. This wallet is custodial. You are responsible for all activity conducted through this wallet.
• Virtual Currencies and Items: The Services feature a complex in-game economy. You acknowledge that all in-game currencies and items are virtual assets licensed to you and are not personal property.

3. Virtual Currencies, Items, and Assets

The platform features a multi-currency economy. By using the Services, you acknowledge and agree to the following:

• FUEL: You acknowledge that FUEL is a promotional metric, not a currency, earned through specific platform activities. It has no monetary value, cannot be purchased or traded, and its sole purpose is to be used as an entry mechanism for specific in-game features.
• GOLD: You acknowledge that GOLD is the primary in-game virtual currency used for all activities within the open world. You acknowledge and agree that GOLD has no cash value and can never be redeemed for fiat currency, other cryptocurrencies, or anything of monetary value from us or any other party.
• ENERGY: You acknowledge that ENERGY is a limited, free-to-play virtual currency that may be awarded to you by us. It has no monetary value and is intended solely for limited access to certain free-to-play features.
• GEMS, LOOT, Pitpets, and other Virtual Items: You acknowledge that all other in-game assets are virtual items. Your acquisition of these items constitutes a limited, non-transferable, revocable license to use these items only within the Services. We reserve the right to manage, regulate, modify, or eliminate these virtual items at our sole discretion, and we shall have no liability to you or any third party for the exercise of such rights.

4. Competition & Gameplay Rules

• Objective: The objective of each Race or competitive event is to achieve the highest "score" as defined by the specific rules of that event.
• Winner Determination: The participant with the highest legitimate score at the conclusion of an event is the winner. All decisions made by SfW are final and binding.
• Prizes: We reserve the right to withhold prizes if we suspect fraudulent activity, collusion, or a breach of these Terms.
• Market Risk Disclaimer: The listing of a token does not constitute an endorsement. You acknowledge that all crypto tokens are subject to extreme price volatility. SfW assumes no liability for financial losses incurred due to the price fluctuations of any token.

5. In-Game Entertainment Features

You acknowledge and agree that all games offered on the platform, including but not limited to slots, arcade games, and poker tournaments ("In-Game Games"), are provided for entertainment purposes only. The virtual currency GOLD used in these games has no monetary value. In the event of an In-Game Game malfunction, bug, or any other error, SfW reserves the absolute right to void all plays and payouts from the malfunctioning game. You agree that you have no claim to any winnings or GOLD that were the result of a known or unknown game error.

6. The $SRY Token

The $SRY token is a utility token. You acknowledge that:

• Ownership of $SRY carries no rights, express or implied, other than the right to use the token as a means to interact with the Services.
• We make no promises or guarantees regarding the value, performance, or liquidity of the $SRY token.
• The buyback-and-burn program is dependent on platform revenue and is executed at the sole discretion of the SfW team.

7. Affiliate Program

SfW may, at its sole discretion, offer an affiliate program. Your participation is subject to separate Affiliate Terms and Conditions, which you must agree to prior to participation. We reserve the right to modify, suspend, or terminate the affiliate program at any time without notice.

8. User Conduct and Prohibited Activities

You agree not to engage in any of the following:

• Market manipulation, wash trading, or any other deceptive trading practices.
• Using automated scripts, bots, or any unauthorized means to interact with the Services.
• Exploiting bugs, glitches, or vulnerabilities in the platform's code or game mechanics.
• Engaging in any activity that is fraudulent, illegal, or harmful to the platform or its users.

8.1. Investigation and Account Suspension

SfW reserves the right, at its sole discretion and without prior notice, to freeze or suspend your account and any associated virtual currencies (including GOLD, GEMS) and assets if we suspect, in our sole judgment, that you have engaged in fraudulent activity, manipulation, exploitation of bugs, or any other breach of these Terms. Such a freeze may remain in effect pending the outcome of our investigation. You agree that SfW shall have no liability or responsibility for any losses you may incur as a result of such a suspension.

9. Fees

• Third-Party Service Fees: To execute trades during Races, the Services utilize third-party protocols (e.g., jup.ag). You will be charged fees directly by these third-party services for your transactions.
• Promotional FUEL Rebate: At our sole discretion, SfW may offer a promotional rebate in the form of FUEL, based on the fees you incur from these third-party services. This rebate is a voluntary, promotional offering and is not a guaranteed right or a refund of fees. We reserve the right to modify, reduce, or terminate this promotional rebate program at any time without notice or liability.

10. Security

We implement security measures but cannot guarantee that the Services will be free from security breaches. You use the Services at your own risk. SfW is not liable for losses caused by security breaches, software bugs, or other technical failures.

11. Third-Party Services

Our Services integrate with third-party services. We are not responsible for the performance, security, or terms of any third-party services.

12. Responsible Gaming Disclaimer

The Services, particularly features involving games of chance, are for entertainment purposes only. We encourage you to play responsibly. You should be aware of the social and financial risks associated with games of chance. Only use funds you can afford to lose. If you feel you may have a gaming problem, we encourage you to seek help from relevant support services. By using our Services, you acknowledge that you are playing at your own risk.

13. Limitation of Liability and Indemnification

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL "SORRY FOR WINNING," ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR FUNDS ARISING FROM YOUR USE OF THE SERVICES.

• No Guarantees or Warranties: The Services are provided on an "as is" and "as available" basis without warranties of any kind.
• No Payout on Malfunction: In the event of a software bug, system malfunction, or technical error, SfW reserves the right, at its sole discretion, to nullify or correct any trades, scores, prize distributions, or the allocation of any virtual assets. You agree that you have no legal claim or right to any payout, prize, or compensation that was erroneously indicated or that you believe you were denied as a result of such a malfunction. You agree to indemnify and hold harmless SfW and its team from any claims arising out of your breach of these Terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

15. Governing Law

These Terms and any dispute arising from them will be governed by the laws of the jurisdiction in which the operating entity of "Sorry for Winning" is incorporated, without regard to its conflict of law provisions.
